2. Specific Conditions of Use of UpHill Simulate

2.1. Application

The present Specific Conditions of Use of UpHill Simulate apply exclusively to UpHill Simulate and establish the rules of operation of the same with regard to its UpHill Simulate Features and external UpHill Simulate Features.

2.2. General information

UpHill Simulate is a web-based application, accessible through any browser through the upsim.io domain, as well as other sub-domains, which are considered an integral part of it. UpHill Simulate is owned and maintained by UpHill. UpHill Simulate is software for analysing clinical compliance metrics supported by an electronic clinical record simulator for training, providing training content for health professionals, aimed at health professionals and health and education institutions. UpHill Simulate allows the creation, dissemination, registration, participation and issuance of a certificate of participation in online training courses, generically called “UpHill Simulate Features”. The set of information available about a course at UpHill Simulate is called "Course". In addition to the UpHill Simulate features, other features are available, which depend on entities external to UpHill, even though they appear, from the point of view of the user interface, integrated ("UpHill Simulate external features"). These features are not considered features of UpHill Simulate, depending partially or totally on entities external to UpHill, regardless of whether these dependencies are explicit for the User or the relationship established between UpHill and the external entities concerned.

2.3. Organisers and Participants

2.3.1. Organisers

Courses are organised, promoted, disseminated and managed by “Organisers”, the use of UpHill Simulate being the sole responsibility of its Organiser. Organisers are Users who, in their personal name or on behalf of a legally constituted institution, started and completed the process of creating at least one Course. Each Organiser accesses the Courses they have created through a User ID and password. Each Organiser is associated with an Organiser Account, which the Organisers must configure. In addition to configuring the Organiser account settings, the Organisers can share, partially or completely, access to the configuration and viewing of Course information created by them with other Users, who will thus also become Organisers of that Account. Organisers are only Organisers of Organiser Accounts created by them or in relation to which this permission has been given by other Account Organisers.

2.3.2. Participants

Users who initiate the registration process for one or more Courses are referred to as “Participants”, even if the registration process is not completed.

2.4. UpHill Simulate features

The “UpHill Simulate features” are features developed by UpHill and included in UpHill Simulate, which depend exclusively on UpHill Simulate itself and / or the hosting services on which it is located. They differ from UpHill Simulate's external features in that they do not have a single external entity responsible for their development and maintenance, even though they may depend on the interaction and / or action of other agents external to UpHill. For this reason, UpHill cannot accept responsibility for any losses that may arise from their non-functioning, for Users or for institutions that they represent. The availability of some UpHill Simulate Features and external UpHill Simulate Features depends on the subscription, by the Organiser, of a Plan, of monthly or yearly duration, to which a cost is associated.

Thus, UpHill Simulate will provide other features, in addition to those described here, when the development team considers they are ready to be made available to Users, due to the positive impact they may have, even if they have not yet passed all stability tests. UpHill will endeavour to mark these features as being in development, whenever possible, but not being obliged to do so, and cannot guarantee or verify their functioning status at all times, which is why it cannot be held responsible for any eventual losses that may arise from their non-functioning, for the Users or for institutions that they represent.

2.5. External UpHill Simulate features

The “External UpHill Simulate features” are UpHill Simulate features that depend, partially or totally, on entities external to UpHill, even though, from the point of view of the user interface, they are integrated in UpHill Simulate, with at least one entity external to UpHill responsible for its development or maintenance, thus depending on the interaction and / or action of other agents external to UpHill. UpHill does not have the exclusive rights to use UpHill Simulate's external Features, nor does it directly or indirectly own the external entities that provide them. If previously informed about the unavailability of any UpHill Simulate external feature, UpHill will try to inform Users about this fact, bearing in mind that this might not happen for the reasons already described in the previous paragraphs, but will not incur any type of liability if it does not do so, in the same terms.

2.5.1. Registration and access to UpHill Simulate through Facebook account ©

Users can choose to sign up and access UpHill Simulate using the same data they use to access Facebook ©. For this purpose, UpHill Simulate provides an interface that allows the User to authorise Facebook © to send certain data to UpHill Simulate. “UpHill Events external features” are UpHill Events features that depend, partially or totally, on entities external to UpHill, even though, from the point of view of the user interface, they are integrated in UpHill Events, with at least one entity external to UpHill responsible for its development or maintenance, thus depending on the interaction and / or action of other parties external to UpHill.
